Notes:

1) This EO is the fourth of six that, as of 8/2019, forms the basis of the sanctions program concerning North Korea. For general discussion on this EO in connection with the other authorities underlying the NKSR, refer to General Comment on the North Korea Sanctions Regulations and the Relationship Between the Authorities Underlying the Regulations (System Ed. Note).

2) This EO is a hybrid IEEPA/UNPA blocking order. See 510.213 (Exempt transactions) for details on how UNPA's involvement in this EO affects available exemptions.

3) The EO is otherwise fully incorporated in the NKSR.

4) EO 13687, based on IEEPA and UNPA, sets out the designation criteria implemented at 510.201(a)(3)(iii), blocking persons carrying the [DPRK2] identifier on the SDN list. This pertains to persons “affirmatively determined” to be related in one way or another to the Government of North Korea (GONK). As noted above, there is a practical difference in being blocked pursuant to EO 13687 and EO 13722—where EO 13722 blocks the entirety of the GONK by operation of law—because the export prohibitions apply to persons blocked pursuant to EO 13687 irrespective of the Department of Commerce’s treatment of a given export.
