Notes:

1) This EO is the second of six that, as of 5/2019, form the basis of the sanctions program concerning North Korea. For general discussion on this EO in connection with the other authorities underlying the NKSR, refer to General Comment on the North Korea Sanctions Regulations and the Relationship Between the Authorities Underlying the Regulations (System Ed. Note).

2) The prohibitions and designation criteria have been fully incorporated into the NKSR.

3) Note that as is the case with a few other sanctions programs, this EO contains what is effectively a "secondary arms embargo," treating military-related sales to North Korea as sanctionable conduct, irrespective of U.S. nexus. In addition, there is the "luxury goods" designation criterion. These are implementations of U.N. Security Council resolutions. The broad designation criteria of EO 13810, making virtually all international trade with North Korea secondarily sanctionable, as effectively rendered those provisions redundant, except insofar as that sort of trade is, for practical purposes, more likely to trigger designations.
