1) BACKGROUND COMMON TO FAQ # 848 - FAQ # 851

On Aug. 7, 2020, several persons were designated pursuant to EO 13936 only (see https://web.archive.org/web/20230219182706/https://home.treasury.gov/policy-issues/financial-sanctions/recent-actions/20200807). On Oct. 15, 2020, the State Department, in the “Secretary of State’s October 14, 2020 report to Congress pursuant to section 5(a) of the Hong Kong Autonomy Act,” identified all of the persons already designated on Aug. 7, 2020 (and no others) as having met the criteria for designation pursuant to the Hong Kong Autonomy Act.

Concurrent with issuance of the “Secretary of State’s October 14, 2020 report,” OFAC amended the SDN entries for the persons designated on Aug. 7 to add a note that reads “Secondary sanctions risk: pursuant to the Hong Kong Autonomy Act of 2020 - Public Law 116-149.”
