Dear Ms. Altieri:
This responds to your letter of September 6, 2007, on behalf of Iowa State University of Science and Technology, seeking to engage in humanitarian transactions in Sudan. On October 13, 2006, the President signed into law the Darfur Peace and Accountability Act of 2006. In light of the Act, and in response to events in Sudan, the President also issued Executive Order 13412, "Blocking Property of and Prohibiting Transactions with the Government of Sudan." The effect of the Act and E.O. 13412 is to exempt specified areas of Sudan, including Southern Sudan, Southern Kordofan/Nuba Mountains State, Blue Nile State, Abyei, Darfur and the marginalized areas in and around...

1) Refer to comment to Case SH-98179b, which is substantively similar to this guidance letter in terms of the activities as issue and OFAC granting limited authorizations for transactions ordinarily incident to those that were exempted by executive order (but not IEEPA).
The difference between Case SH-98179b and this letter is that this letter was issued just prior to the implementation, into the Sudanese Sanctions Regulations, of the territory-specific exemptions mandated by EO 13067.
