[9-30-26 Update – FAQ amended to reflect expansion of 560.209 to “indirect” financial transactions]

1) The scope of this general license is unrelated to the scope of what OFAC would otherwise consider to be transactions "ordinarily incident" to transactions exempt under the Berman Amendment's informational materials exemption as a general matter. With respect to travel in particular, it is OFAC's position, affirmed by the D.C. Circuit [1], that where travel is otherwise prohibited, the Berman Amendment's informational materials exemption does not exempt any travel-related transactions that are directly incident to the importation or exportation of the informational materials.

[1] See Daniel J. Walsh D/b/a Liberation Graphics, Appellant, v. Nicholas F. Brady, Secretary of Treasury, et al, 927 F.2d 1229 (D.C. Cir. 1991).

2) See Case No. CU-2015-318654-1, interpreting broadly the version of this provision amended in 2016.

3) FAQ amended on 9-23-2020 to account for the addition of 515.210 to the CACR.
