General Note on Explicit and Implicit "Facilitation" Prohibitions in IEEPA-based embargoes (System Ed. Note)

1) IN GENERAL

All of the IEEPA-based embargoes active as of 4-14-24 have explicit prohibitions barring "facilitation" by U.S persons of offshore transactions in which the U.S. persons could not engage directly. See e.g. 560.208 of the ITSR, 510.211 of the NKSR, 542.210 of the SySR and Sec. 1(a)(iv) of Executive Order 13685 (the Crimea embargo).

The NKSR and SySR versions appear to be limited in scope, only applying to certain types of transactions that are otherwise prohibited, but those limitations are a quirk of the executive orders that the facilitation prohibitions...
