1) This guidance appears to make clear that, with respect to the provision of carrier services from Cuba to the U.S. within the scope of 515.572(a)(2), the only individuals that may be transported are i) persons subject to U.S. jurisdiction who are traveling to or from Cuba pursuant to a general license under one of the 12 categories, ii) certain Cuban nationals, and iii) certain foreign nationals travelling in connection with official governmental and intergovernmental organizational travel.
These limitations are crafted so as to exclude the majority of persons that are i) not subject to U.S. jurisdiction, but ii) whose travel falls within the scope of one or more of the CACR’s travel-related 12 general licenses.
