1) But note the exemption for software not subject to the EAR and otherwise meeting the boilerplate standards of the "informational materials" exemption, including the definition of "informational materials" (e.g. 560.210(c), 560.315).

2) OFAC confirms in the following FAQ that the Berman Amendment exemptions to IEEPA (in that case for travel) apply to the Cyber-related sanctions regulations even though they are abbreviated and contain no “exempt transactions” section.
