1) Background

Judging strictly by the published federal court opinions, OFAC’s licensing determinations are extremely difficult to challenge in federal courts. This is true to an extent—such is the nature of the level of deference owed to the agency under the APA—but OFAC does have a practice of settling prior to courts issuing decisions that seem likely to set unfavorable precedents for the agency. The following is a list of items, mostly licensing determinations, the challenge of which resulted in what appears to be successful litigation against the agency that is not reflected in any published court opinion.
