1) The background of this letter is a longstanding anti-dumping order—renewable every five years depending on the outcome of a “sunset review” [1]—that sets import duties on the importation of pistachios from Iran to the U.S.

The importation of pistachios from Iran to the U.S. is, as of 7/2021, prohibited by the ITSR, but such importation was generally licensed as of the date of the letter by the JCPOA-related GL pertaining to the importation into the United States of Iranian-origin carpets and foodstuffs. Importers (and industry associations) involved in trade remedies cases frequently contract with local service providers in the exporting jurisdiction to obtain information that can be used in the submissions made to the Department of Commerce and U.S. International Trade Commission.
