This appears to be the first Cuba-related case in which the facts describe circumstances that in other programs would be considered "facilitation." This assumes that the U.S. company was arranging for the shipment of a non-U.S.-origin item from a third country to Cuba. Note that there is no express prohibition on facilitation in the CACR, but OFAC considers the scope of prohibited facilitative conduct to be no more narrow than is the case with, for example, the ITSR (560.208).
