This FAQ, along with a 2006 license issued in connection with the Zimbabwe sanctions program, was at the heart of Exxon Mobil Corporation et al v. Mnuchin et al, No. 3:2017cv01930 (N.D. Tex.), challenging a 2017 OFAC Penalty Notice. The FAQ and license serve as the primary bits of evidence that the "signature-as-service" position taken by OFAC in the Exxon case was both noticed to the public and consistent with OFAC's longstanding interpretation of the scope of the term "service."
