2) This FAQ is a straightforward application of the carveouts in paragraph (b) in GL 46. OFAC is evidently looking to restrict transactions involving Chinese/PdVSA JVs in Venezuela and exclude Chinese subsidiaries from acting as an “established U.S. entity,” but there is nothing excluding Chinese entities being end users of oil purchased by qualifying established U.S. entities.
