In JCPOA Implementation FAQ K-13 and JCPOA Implementation FAQ M-9, OFAC says "the exportation or reexportation of U.S.-origin goods that are designated as EAR99 from a third country to Iran without knowledge or reason to know at the time of export from the United States that the goods are intended specifically for Iran is not prohibited. Additional export controls administered by the Department of Commerce may also apply". Implicit in those statements in that non-U.S. persons can generally export goods of U.S. origin to Iran where such goods are designated as EAR99, even when the non-U.S. person exporter has "actual knowledge" of Iranian destination of the goods.
