538.414 interprets a standard, IEEPA-based "exports of services" prohibition [1] in the context of a full-scale embargo that did not have a discrete prohibition against "new investment" in the sanctioned country, as is the case with all IEEPA-based sanctions programs active as of 5/2019. (See 510.209 (NKSR); 542.206 (SySR); 560.207 (ITSR)).

The "new investment" prohibitions in currently active programs all prohibit "loans or extensions of credit," a term which in the NKSR and SySR is the subject of a separate, 300-level definitional provision [2]. Those definitional provisions defining "[l]oans or other extensions of credit" for the purposes of the "new investment" prohibitions do not specify that there are prohibitions on:
